These Terms govern your access to and use of the Ocean Green application and this website (together, the "Service"), operated by the provider named in the Imprint ("we", "us"). By using the Service you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract. The Service is a professional tool intended for adults.

2. What the Service is

Ocean Green is an operator tool to create and manage synthetic ("AI-generated") model personas and their content, to schedule and assist publishing, and to track cost and performance. You are the operator; you decide what is created and published, and you are responsible for it.

3. Acceptable use

You agree that you will not use the Service to:

  • depict or impersonate a real, identifiable person without lawful right, or create content depicting minors or anyone appearing under 18;
  • produce sexually explicit, non-consensual, hateful, harassing, deceptive or otherwise unlawful content;
  • remove or falsify AI-content disclosure, or misrepresent AI-generated media as real;
  • circumvent any platform's rules — including using unofficial automation, bots, scraping, or fake-engagement (follow/like/DM automation) — or violate the terms of Instagram/Meta or any connected service;
  • infringe intellectual-property, privacy or personality rights of others.

The Service ships with guardrails (SFW sanitiser, disclosure, brand-safety lint, official-API-only publishing). These reduce risk but do not transfer responsibility: complying with each platform's terms and applicable law remains yours.

4. Third-party platforms & providers

Publishing and insights use Instagram's official Graph API and are subject to Meta's terms. Generation uses your own model-provider (OpenRouter) key and is subject to that provider's terms. You are responsible for maintaining your accounts and keys and for any costs your usage incurs with those providers.

5. Costs & billing

Generation costs are pass-through: you pay your model provider directly, and the app tracks and reconciles those costs for transparency. Any subscription fees for the Service itself will be described at the point of purchase. Pricing during the beta is indicative and may change.

6. Your content & ownership

You retain ownership of the content you create, subject to the rights of the underlying model providers and platforms. You grant us only the limited rights necessary to operate the Service for you (e.g. storing and serving your media within your instance). We claim no ownership over your personas or media.

7. Availability & changes

The Service is provided on an "as is" and "as available" basis, particularly during beta. We may modify, suspend or discontinue features. We aim for reliability but do not guarantee uninterrupted operation.

8. Disclaimer & liability

To the extent permitted by law, we exclude implied warranties and are not liable for indirect or consequential damages, lost profits, account suspensions imposed by third-party platforms, or costs incurred with model providers. Nothing in these Terms limits liability that cannot be limited by law (e.g. for intent, gross negligence, or injury to life, body or health). 9. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or unlawful use.

10. Governing law

Mandatory consumer-protection provisions of your country of residence remain unaffected.
